I might go to jail

This is quite a complicated and worrying problem for me, and I am wondering if anybody has ever been in the same situation. I have been charged with a criminal offence, and there is the strong possibility I might get a jail sentence. This obviously means I am going to lose my job as well.

I have a partner who doesnt live with me, but is due to move in with me in 6 weeks time, and is sticking by me as are all my friends and family. The big issue for me is finance and how she is going to cope if I get a jail sentence, so in the short term I got a bank loan of £3k which I want her to use in the short term to supplement any money she has coming in.

The downside is although I work, I am confident I will be entitled to legal aid, but I now have a bank balance of £3k+ so when the Legal Aid board see that they might turn down my request. I dont know whether I could put the money into her bank account and not my own. I specifically got the loan so she could in the short term still run the house, so I dont know whether to move the money into my fathers bank account, my partners bank account or some other alternative.

I just cant afford to pay full lawyer costs, but I am scared that if I don't move this money out of my bank account quickly the vast majority might get eaten up to pay for my solicitor. When I first got charged, I obviously didn't have a large amount in my bank, so it looked like Legal aid would be granted without a problem.

Although getting the bank loan, will help us financially, it has created another big problem with me from the solicitor point of view. I would be grateful for any advice.

Get real you are going to probably go down for a stretch so you take out a 3K loan to make life comfortable for a girl who dosent live with you yet!!!! Er! Planet earth mate. Pay it back lock your door and stand up and speak the truth. You got no money but you have a job and a family that are standing by you for nothing but love. This life is about equality women no longer have to rely on a man for everything we more than often earn more money than guys anyway. Tell her to get the loan and a job.

its a shame that you are in this situation my m8 but you should remember that the law is this so long as you dont tell them you have the savings then ok one last thing is this,providing you dont earn more than 12,000 a year you are entitled to legal aid, there are a few solicitors who will talk you through this. i only know this as i had a bit o trouble my self and asked

you don't mention at any point who is going to pay this loan back to the company you borrowed it from, seems you want your cake and be able to eat it.

why do you have to go to court? It must be something you did so dont you think you should pay and your partner stay were she is for now.

Hi it sounds to me like you have genuinelly took out the loan to help your partner cope financially if you go to jail.
i would suggest moving the amount to your fathers account so he can make sure that the loan is used for the purpose you took it out.

legal aid is for people who can not afford representation in court, but it sounds to me by what you have said, that you could not afford to pay for a lawyer before you took out the loan so therefore you need assistance to pay for legal representation.

obviously i am only going on what you have said on face value.

You should probably move the money if you would like Legal Aid, but you should remember that Legal Aid was set up for people that really can't afford representation in a court, which you now can, so you will be taking necessary funding away from them, which is unfair. Try to find another way if possible.
